Introduction

These terms and conditions apply between you, the User of our Website(s) (including any sub-domains, unless expressly excluded by their own terms and conditions), and The NAPIT Group Limited, the owner and operator of the Websites stated below. Please read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of one of the Websites listed below. If you do not agree to be bound by these terms and conditions, you should stop using the Website(s) immediately.

In these terms and conditions, User or Users means any third party that accesses the Website and is not either (i) employed by The NAPIT Group Limited (and any of its subsidiary companies) and acting in the course of their employment or (ii) engaged as a consultant or otherwise providing services to The NAPIT Group Limited and accessing the Website in connection with the provision of such services.

Intellectual Property And Acceptable Use

1. All Content included on the Website, unless uploaded by Users, is the property of The NAPIT Group Limited, our affiliates or other relevant third parties. In these terms and conditions, Content means any text, graphics, images, audio, video, software, data compilations, page layout, underlying code and software and any other form of information capable of being stored in a computer that appears on or forms part of this Website, including any such content uploaded by Users. By continuing to use the Website you acknowledge that such Content is protected by copyright, trademarks, database rights and other intellectual property rights. Nothing on this site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, logo or service mark displayed on the site without the ownerʼs prior written permission.

2. You may, for your own personal, non-commercial use only, do the following:

  • a. retrieve, display and view the Content on a computer screen
  • b. print one copy of the Content
  • c. download extracts of the Content

3. You must not otherwise reproduce, modify, copy, distribute or use for commercial purposes any Content without the written permission of The NAPIT Group Limited.

10. Any online facilities, tools, services or information that The NAPIT Group Limited makes available through the Website (the Service) is provided "as is" and on an "as available" basis. We give no warranty that the Service will be free of defects and/or faults. To the maximum extent permitted by the law, we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality. The NAPIT Group Limited is under no obligation to update information on the Website.

11. Whilst The NAPIT Group Limited uses reasonable endeavors to ensure that the Website is secure and free of errors, viruses and other malware, we give no warranty or guarantee in that regard and all Users take responsibility for their own security, that of their personal details and their computers.

12. The NAPIT Group Limited accepts no liability for any disruption or non-availability of the Website.

13. The NAPIT Group Limited reserves the right to alter, suspend or discontinue any part (or the whole of) the Website including, but not limited to, any products and/or services available. These terms and conditions shall continue to apply to any modified version of the Website unless it is expressly stated otherwise.

Limitation Of Liability

14. Nothing in these terms and conditions will:

  • a. limit or exclude our or your liability for death or personal injury resulting from our or your negligence, as applicable;
  • b. limit or exclude our or your liability for fraud or fraudulent misrepresentation; or
  • c. limit or exclude any of our or your liabilities in any way that is not permitted under applicable law.

15. We will not be liable to you in respect of any losses arising out of events beyond our reasonable control.

16. To the maximum extent permitted by law, The NAPIT Group Limited accepts no liability for any of the following:

  • a. any business losses, such as loss of profits, income, revenue, anticipated savings, business, contracts, goodwill or commercial opportunities;
  • b. loss or corruption of any data, database or software;
  • c. any special, indirect or consequential loss or damage.

General

17. You may not transfer any of your rights under these terms and conditions to any other person. We may transfer our rights under these terms and conditions where we reasonably believe your rights will not be affected.

18. These terms and conditions may be varied by us from time to time. Such revised terms will apply to the Website from the date of publication. Users should check the terms and conditions regularly to ensure familiarity with the then current version.

19. These terms and conditions together with the Privacy Policy and Cookies Policy contain the whole agreement between the parties relating to its subject matter and supersede all prior discussions, arrangements or agreements that might have taken place in relation to the terms and conditions.

20. The Contracts (Rights of Third Parties) Act 1999 shall not apply to these terms and conditions and no third party will have any right to enforce or rely on any provision of these terms and conditions.

21. If any court or competent authority finds that any provision of these terms and conditions (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision will, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of these terms and conditions will not be affected.

22. Unless otherwise agreed, no delay, act or omission by a party in exercising any right or remedy will be deemed a waiver of that, or any other, right or remedy.

23. These terms and conditions will be governed by and interpreted according to English law. All disputes arising under these terms and conditions will be subject to the exclusive jurisdiction of the English courts.

Training:

1. For the purposes of the terms and conditions, courses sold publicly and held at a NAPIT Training venue will be referred to as ‘Standard Training courses’. Training which is delivered by NAPIT which contains content bespoke to the customer, is delivered onsite or at a location of a customers choosing or space cannot also be sold to the public, is referred to as ‘Bespoke Training’. Courses which are accessed online are referend to as ‘E-learning’. 

Training Courses Limitations and Liabilities:  

2. NAPIT Training and its trainers have the right to refuse entry to any candidate who fails to arrive at the correct venue, or on the correct date or time. In addition to this, we reserve the right to refuse training to any candidate(s) that knowingly breach any provision under the Health & Safety Act or fails to comply with any relevant and stipulated requirements, e.g. suitable clothing and equipment. The same applies to any candidate(s) who conduct themselves inappropriately with any offensive, disruptive or illegal activity. Under all such circumstances, candidates will be asked to leave the course without a refund or remuneration of any fees paid to date. 

1. NAPIT Training will not be held responsible for any failure to comply with course pre-requisites and provide evidence as set by the awarding organisation; this may result in you being unable to undertake the course and/or no formal certificate being received without a refund or remunerations of any fees paid to date.

3. The liability of NAPIT Training for any expense, cost or damage of any kind whatsoever whether direct, indirect or consequential to the candidate and/or name booking contact (apart from personal injury or death) as a result of any action carried out by us, relating to any services or equipment provided in accordance with our course requirements and procedures is limited to the total amount of fees paid in respect of the course and/or assessment per affected candidate. 

4. NAPIT Training will not be held responsible for any loss or damage to personal belongings whilst candidates are present at any of our venues, or whilst we are providing onsite training at your own premises. 

5. NAPIT Training reserve the right to alter or cancel any published or booked course dates, change venues and/or lecturers without liability. In these circumstances, you will be offered an alternative course date, or a full refund limited to the total amount of fees paid in respect of the course and/or assessment per affected candidate. 

6. NAPIT Training are unable to offer refunds for cancellations arising from events outside of our control including adverse weather conditions, flooding or industrial action, however we will, on all occasions where possible, offer alternative course dates for all candidates. 

Standard Training Courses 

7. Please note that a candidate place is not confirmed until a booking confirmation is issued by NAPIT Training; if this is not received by email within 48 hours of booking the required course/assessment online or by phone, then please call us 0345 543 0330 or send us an email to [email protected]

8. All NAPIT Training courses can be paid by Card, Bank Payment or Direct Debit. 

9. Where applicable, training product charges include a single examination attempt per delegate. Any additional attempts will be chargeable and payable prior to confirmation of booking. 

10. Course fees must be paid in full at least 30 days prior to the course commencement date unless other terms have been specifically agreed.  

11. NAPIT reserves the right to refuse admission to a course where the full fees have not been received.  

12. NAPIT reserves the right to relist a course where full payment has not been received 30 days prior to the course. 

13. Please note that late or non-payment of our course fees may result in the cancellation of your course booking, and a minimum administration fee of £75.00 + VAT will be charged per candidate place cancelled.  

E-Learning Courses 

14. Unless stated the e-learning package is available for 12 months from enrolment only. 

15. Any payment made for courses with an e-learning pack confirms that the candidate fully understands and agrees to the creation of an e-learning account and registration with the awarding body, both of which are non-refundable. See below for breakdown of all costs, all prices are plus VAT: 

16. Admin: £60.00 (non-refundable) 

17. Telephone Induction/Skill Scan: £60.00 (non-refundable, following successful skill scan you are registered with City & Guilds and onto the e-portfolio) 

18. City & Guilds registration fee: £300.00 (non-refundable) 

19. e-Portfolio fee: £150.00 (non-refundable) 

20. Note: Further charges apply based on progress through the qualification. 

21. We will try to accommodate any amendment but if registration to online learning resources have already been made then 50% of the course fees will be chargeable. 

22. As soon as any course containing an e-learning work pack has been booked, the customer has committed to the course and any fees incurred with the set up plus 10% of the course fees plus VAT. These costs are non-refundable as these are part of the service performed by NAPIT Training throughout the booking process, (the minimum charge will be £75.00 + VAT). 

Booking Amendment Policy 

23. All course/assessment booking amendments are subject to the following charges: 

24. If a course/assessment booking is amended due to a requested change of date, location and/or candidate(s) 30 days or more prior to the course/assessment start date, then no administration fee will be charged. 

25. If a course/assessment booking is amended due to a requested change of date, location and/or candidate(s) 14 - 29 days prior to the course/assessment start date, then an administration fee of £75.00 + VAT will be charged per candidate place amended. 

26. If a course/assessment booking is amended due to a requested change of date, location and/or candidate(s) 7 - 13 days prior to the course/assessment start date, then an amendment fee totalling 50% of the original course/assessment cost will be charged per candidate place amended, (the minimum charge will be £75.00 + VAT). 

27. If a course/assessment booking is amended due to a requested change of date, location and/or candidate(s) 0 - 6 days prior to the course/assessment start date, then an amendment fee totalling 100% of the original course/assessment cost will be charged per candidate place amended, (the minimum charge will be £75.00 + VAT). 

28. NAPIT will not refund or move 2396 exams as they are booked and registered in advance. 

Cancelling a Training Course

30. All course/exam booking cancellations are subject to the following charges: 

31. If a course/assessment booking is cancelled 14 days or more prior to the course/assessment start date, then an administration fee of £75.00 + VAT will be charged per candidate place cancelled. 

32. If a course/assessment booking is cancelled 7 - 13 days prior to the course/assessment start date, then a cancellation fee totalling 50% of the original course/assessment cost will be charged per candidate place cancelled, (the minimum charge will be £75.00 + VAT). 

33. If a course/assessment booking is unattended or cancelled 0 - 6 days prior to the course/assessment start date, then a cancellation fee totalling 100% of the original course/assessment cost will be charged per candidate place cancelled, (the minimum charge will be £75.00 + VAT). 

34. Any discounts and/or free training granted to you by NAPIT are non-refundable and non-transferable.  

E-learning Course Cancellations 

35. As soon as booking of any course containing an e-learning work pack has been made, the customer has committed to the course and we are not able to cancel or transfer this course. 

Bespoke Training  

36. Bespoke training content will be outlined in the specification document included in the quotation. 

37. It is the client’s responsibility to ensure the training course is suitable for their purpose, and that delegates are advised of the venue, date and time.  

38. Quoted prices are all subject to VAT. 

39. Quotes are valid for 30 days. 

40. Prices are inclusive of the following: 

(a)  Training delivery on the day(s). 

(b)  All relevant course materials. 

(c)  One examination attempt.  

(d)  Lunch and refreshments will be provided for courses delivered at NAPIT venues. 

41. Any additional examination attempts will be chargeable: 

(a)  Payments can be made by card or bank transfer. Payment is due immediately on booking unless otherwise agreed. 

42.  Unless by prior agreement, cleared payment must be made before the course commences. 

43.  Should a course be rescheduled by the client for any reason, we reserve the right to charge an administrative fee and to recover any costs associated with setting up the course. 

44.  We reserve the right to cancel the course if fees are not paid on time.  

45. The trainer has the right to refuse entry to any delegate who fails to arrive at the correct venue, or on the correct date or time, or who in their opinion is unfit to take the course, or whose conduct or behaviour is disruptive. The decision of the trainer on the suitability of the delegate to complete the course shall be final and binding. 

46. It is important that the named booked delegates are present at the training. Some external certification bodies do not permit substitute delegates to sit a scheduled examination.  

47. It is possible, however, that we can arrange a future examination for an additional delegate which may incur additional charges, such as examination fee. 

Bespoke Course Cancellation  

48. Bespoke course cancellations policy:  

49. 6 weeks (or more) prior to course start date – full refund minus a cancellation charge of £250 + VAT per day of delivery booked. 

50. 3-6 weeks prior to course start date - 50% refund of course fees. 

51. Within 3 weeks of course start date - Non-refundable, course fees non-transferable. 

52. External Examinations (e.g. City & Guilds), once a candidate has been enrolled on to an examination (usually 4 weeks prior to the date arranged) substitutions cannot be made and the fees are non-refundable/non-transferrable.
